    Absolutely!  This happens all the time - neighbour was offended by the action and makes up a tale to worry the culprits, passing the blame onto the Council.

    Leaves are technically not litter. I doubt your mother as anything to worry about.

    Assuming then that the leaves didn't have your Mum's name on them, the person concerned only has evidence of the leaves leaving the premises, not what happened to them afterwards. Your Mum was obviously about to combine them with the detritus in the road and clear everything up.
    But it's also odd and unprofessional of the person to discuss this with the neighbour, instead of approaching your Mum directly  to get the facts. It's that which will probably ensure this never sees action in any court.
