  • I understand that Atol only cover in case of a company going out of business. Not cancelled etc

That is true. But if an ATOL certificate was issued then it proves it is indeed a package.
  • Bagand96, it does indeed, I didn't pick up on that inference. I was only highlighting to op that they wouldn't have an Atol claim under cancellation etc. Thanks for clarification.

Jet Line Travel have said although we booked everything through them it is NOT a package deal (we weren't aware of this) and flights and accommodation were booked separately (but they were all done through them!).

their website front page says -

All the package holidays we sell are covered by a scheme of financial protection and we’ll tell you before you book if you’re buying a package. For other travel arrangements, please ask us about financial protection. Some of the flights and flight-inclusive holidays on this website are financially protected by the ATOL scheme.

But ATOL protection does not apply to all holiday and travel services on this website. This website will provide you with information on the protection that applies in the case of each holiday and travel service offered before you make your booking. If you do not receive an ATOL Certificate then the booking will not be ATOL protected. If you do receive an ATOL Certificate but all the parts of your trip are not listed on it, those parts will not be ATOL protected.

were you advised it was an ATOL protected package before you booked?

  • The issue I have is that they are saying it wasn't booked as a package but clearly it was, no alternative has been found and they expect us just to go over there and be told where our new hotel is - I am not prepared to take that chance and feel they should either give us a refund or arrange an alternative at this end...............I feel like we are just going round in circles, RyanAir are saying it is up to the Travel Company to refund us and they claim back from them, holiday company saying as we have booked separately (although we haven't!) they are only responsible for Hotel and as RyanAir are flying we need to take it up with RyanAir - nightmare!

No, the issue is do you have an ATOL certificate. Some tour operators act as agents and book each part separately , so it is not a package.
The   information given above is  relevant
But ATOL protection does not apply to all holiday and travel services on this website

  • Doesn’t sound like a package tbh as OP states the flights are paid for but hotel isn’t?  Don’t you normally just pay all to agents for package and not aware of who they pay when?  Been my experience in past anyway.   But yes the ATOL certificate will tell all.

Current discussion relates to a different case from the thread-starter's....
  • Ooops sorry - my mistake - I will go read properly :)
