Liverpool airport no stopping advice?

Hi I am in conflict with www.myparkingcharge.co.uk who have tried to make me pay £160 balance and given me a deadline of 10 days .

My daughter was late getting in from the airport and it was dark, I waited outside the airport until she rang and then drove into Liverpool airport, as I neared the arrivals I saw her walking out of the airport and went into the lay-by off the main road and actually stopped next to the cctv van, I placed my disabled badge in the window and he ignored it and she got into the car and we drove home, at no point did he wind down the window and ask me to move on and at no point did na acknowledge that I had not actually stopped the car engine as it literally was around 30 seconds.

I wonder if anyone could advise me please as I have tried every avenue to get some sort of common sense on this and they are now sending a red letter with DEMAND FOR PAYMENT at the top?

I would of happily paid the £2 arrivals fee but my daughter thought it was a good idea to walk out of the main arrivals to meet me and the rest is history ...........

I am happy to go to court to defend this as even with red lines and no stopping signs are disabled drivers not even given a short grace period of notice or am I simply going to have to talk to a judge?

many thanks

Steve

    hi!
Have you read the newbies thread?
Firstly, noone gives two hoots about debt collectors, and that goes to you as ewll. Theyre powerless. Oh no, it has a red banner across the top. Its still a letter, and debt collectors cant do anything except send these stupid letters. Ignore them. Thats what we do
Secondly, go ahead and read the newbies thread again. It tell syo uexactly what to do if they are moronic enough to try court
Thirdly, do some obvio0us searches - use the forum as it is intended - and see how others are dealing with exactly the same issue as you.

Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up,

Just as the clampers were finally closed down, so hopefully will many DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

Why not read the other VCS Airport threads?   We have loads, including yet another one today.

You will need to know how to defend this in court, unless you can get the Airport to cancel it by complaining to them.

We win v VCS re claims relaing to 'no stopping' at Airports.   This is a scam site.

There is no appeal that works but you must dispute it now, with a copy of your Blue Badge, because that looks more reasonable later when you win at your local court.  However, VCS wil NOT cancel it unless the Airport tells them to, so the weight of your dispute and complaint must be aimed at the Airport (Google for contact details for the owners).

  • Thank you everyone, I have copied Liverpool airport into my emails to them, alas they are taking a cut so no real compassion from them on this.

I think my biggest disgust is that I stopped right next to the CCTV van off the main road and by the roundabout he sits at 24/7, less than a minute as my daughter was walking across the road and never once did he actually simply wind down the window and simply say “ Disabled badge or not, move it” and would of happily gone into arrivals and paid the £3 pick up, what kind of people are these when you can do that knowing you are being inhuman over money to decent people !

I will go to court as they have upset me greatly, I have added it to my medical records the stress levels of it all and win or lose I have to try for everyone else and then pass it on for others to read and hopefully also not be afraid of them.

Have a great day everyone 👍

just to give you an idea as to how these scammers are viewed ...

''Rip-offs from car park Cowboys must stop''; unfair treatment; signage deliberately confusing to ensure a PCN is issued; ''years of abuse by rogue parking companies''; bloodsuckers; ''the current system of regulation is hopeless, like putting Dracula in charge of the blood-bank''; extortionate fines; rogue operators; ''sense of injustice''; unfair charges and notices; wilfully misleading; signage is a deliberate act to deceive or mislead; ''confusing signs are often deliberate, to trap innocent drivers''; unreasonable; a curse; harassing; operating in a disgusting way; appeals service is no guarantee of a fair hearing; loathed; outrageous scam; dodgy practice; outrageous abuse; unscrupulous practices; ''the British Parking Association is as much use as a multi-storey car park in the Gobi desert''; and finally, by way of unanimous conclusion: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists and ordinary residents should not have to put up with this''.

    ·    These are the exact words used by MP's so you should quote them to your MP in a complaint and ask that they intervene.

My heinous crime was an 8 seconds stop many years ago ... so this is not new.

follow the good advice you have been given and keep reading forum guidance

As far as I can recall there has only been one serious VCS LJLA court case which ended with the defendant calling it a day after an adjournment, with the second hearing being scheduled for an inconvenient date.

For sure, unlike some other infamous parking/stopping sites, there is no avalanche of court cases for this one. While you'll have to put up with the silly debt collector letters - I see you've had the 'red top' one, so the next will be the one threatening to skin your cat, followed by the ultimate, the kidnapping of your children - the prospects of a court case, I'd say, are pretty remote.

There's only need to come back if you receive a Letter of Claim from VCS (or their solicitors) or a Court Claim via the Northampton CCBC.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Same here, that's the only one I can remember in the last 5 years; although, there was the "breakdown" claim which the motorist won in January 2014:-

    Have you read this?

Have they complied?  If not, and they take this to  court, consider a counter claim against the PPC and the landowner for disability discrimination.  l,,

If this did go to court, then isn't the use of a disabled badge to enable an activity that didn't require you to leave your vehicle an extremely poor defence?
