Misrepresentation on car sale

Hi there all
I have recently bought a nearly new car advertised as a 200BHP model. The contract of sales also described the car as a 200BHP model . 2 weeks down the line I find out it is a 150BHP model - at least £2k cheaper than the £20k I spent on it . I negotiated £4k off the asking price and as a result agreed a basic part x amount for my car . Having called it out to the dealership they are only offering me a refund which squares them off but leaves me at a disadvantage as I only agreed to the part x as part of the overall deal. What should I do here as it feels like the garage is getting away with breaking the law with zero recourse on them ?

    The garage didn't notice! How awful... Oh, wait - you didn't, either. Ooopsy. You should both have paid attention - anything vaguely recent has the power output clearly stated on the V5C.

    You've been offered a full refund, so take it and get on with your life.

    The cost to change was acceptable to you two weeks ago.
    How that's structured - whether it's £20k - £10k PX = £10k or £16k - £6k PX = £10k - doesn't affect the final deal.
    You paid £10k to upgrade from your old car to this one, and you're getting that self-same £10k back from having unwound the deal. They can't (I presume) return your car because they no longer have it, so you get what you agreed to be the monetary value instead.

    The garage have made a mistake, admitted it, and offered a full refund. What law do you imagine they're breaking?

    Are they returning to you £20k plus the part-ex value of your old car? Or £20k plus your old car back?

    The basic part-ex value was likely the true value ... higher part-ex valuations are merely a game to make the deal seem sweeter.

    Arrrr so if it was a 150hp car you would of asked for a higher part exchange?
    Refunding you in cash in full (including your part exchange) is a win for me as well.

    150 vs 100 would be noticeable ... 200 vs 150 would not (in the real world).

    However it seems that the OP is another OPW.
  • To be fair this kind of thing is a real pain in the backside. Okay you get the money back but you have to then go find another car. If you are lucky it will be quick, otherwise you could be stuck without one or forced to buy something you don't really want quickly.

    Legally the dealer is off the hook with a refund but that doesn't make it any less unpleasant.
