Shielding and SSP

My wife works for a care company that is Government / council funded (important this) and has been shielding from the start. However, she has only been getting SSP as the company state they cannot furlough her due to the fact they are government funded. I have read somewhere that in this case she should be getting her full pay rather than SSP as her position is funded and also she is a key worker... is this correct in what I read and should we take some legal advice because as far as I can see they are being paid by the government for her to work and also claiming back the SSP so in effect being paid twice!

No, it was only ever SSP with a choice of paying furlough if the employer so wished and could. Unfortunately being public funded removed the furlough route for your wife.
Care companies or homes are not paid by the government/LA based on the number of employees but the number of people they are contracted to look after. The company are not getting paid twice for one person.0 -
The company have had to use the funding to pay somebody else to do your wife’s job whilst she was off. So they have not been paid twice for your wife.
