What am I entitled to under Section 75

Options
I've been stung on remedial work that was started just before lockdown by Everest Windows. As is widely known, they're now in Administration and have absolved themselves from any further responsibility to fix their mess (which I'd been trying to get resolved since they were installed 2.5 years ago! Yes, they're that shoddy!)
I have little choice but to submit a Section 75 claim to either our credit card company we paid the deposit on or the finance company Everest arranged for us for the remaining amount.
As they'd agreed to replace pretty much every single thing they installed (VERY badly and also damaging most things at the same time, I'll add) - am I entitled to a full refund from either creditor? Or will they only be liable for 3rd party remedial work to take place to 'make good' what should have been installed? Or a partial refund on what they believe is faulty? I fully expect to have a visit from someone to assess.
I believe, reading through the law, that as all the goods are faulty, I should get a full refund, as I now have to get all my windows and doors replaced.
Thanks to everyone and stay safe!

As you paid for part of the amount involved by credit card, I would start there. They may have to pay all of it. See https://www.moneysavingexpert.com/shopping/section75-protect-your-purchases/

Everest's windows business was acquired by Everest 2020 Limited on 8 June. Have they contacted you?
  • Yes, they've said they're not going to help and to seek assistance elsewhere. I'm just not 100% sure what I should be asking for from the credit card company - as I'm unsure if this scenario warrents a full refund of the costs.

Talk to the credit card company and explain the situation.

How did you get on? We're in a similar position.

A section 75 claim is no different from claiming from the company for recompense as the CC company and the retailer are jointly liable. You have to get an estimate of how much it would cost to get you back to the state you ordered and paid for. The idea is that you get what you ordered in full through self-help. Same as making a claim on car insurance where there is a loss adjuster to put you back to a position you [should have] been in before. Essentially you are making an insurance claim on the CC Co.

Which has advice including the opportunity to go to the Ombudsman if you cannot get agreement

    • All land is owned. If you are not on yours, you are on someone else's
    • When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
    • "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere
    • All land is owned. If you are not on yours, you are on someone else's and their rules apply.

Just compiling the quotes for the remediation works/replacement goods/damage repair to send to the finance company as part of my claim relates to installation. i hope to have these sent off; along with photos and evidence in the next few days.
  • Everest back with the same pirates that joined them in 2019.  I assume with loads of creditors (which the OP is one off) shafted ?
Maybe Mr Bostock can "glue" a few faulty windows.
