    If the landlord is aware of the drug taking and fails to take action, the free holder could take them to court.

    I think it is possession that is illegal, not the smoking.
    How do you smoke something if you don’t actually possess it? Does someone else hold the joint and you leave over and inhale?

    That is an odd image in my mind now, like something from a cartoon.

    I wonder if the OP can update us on how the viewings went?  The flat could be sold by now.

    If you're trying to sell , don't make waves because as soon as you start going down the official route - ie  calling police , councils , etc you will have to declare this when you sell and this will put people off

    Yes , I worded that  wrongly.  They do , for example , for risk to life  other reasons.

    They have no power to enter the property without a warrant on a suspicion that someone is smoking weed inside there.

    And yes , it is unpleasant and anti social but the police really do not have the resources or the inclination to deal with it. If it were to be reported , it would go nowhere.  It would be logged down for information and nothing would happen.

    You would then have to declare this when you sell the property
