Withheld furlough money

Hello I am looking for some help. I have been employed by an agency and have been working for a company through them since august 2019. I have been furloughed but the Company I work for are planning to take me on as a contract worker once Covid-19 is over. The payroll company that pays be have payed me for weeks 1-9 of the furlough grant from the government but have now emailed me stating they are not bothering to put applications in for the grant anymore because it has been a long process for them to do so, this means I will be losing out of 5 weeks furlough payment that I am entitled to. Are they allowed to do this?

    I’d be very surprised if they are allowed to get away with that... 

    Im no legal expert, but if you were employed for that period and they now aren’t counting you as furlough for that period because they aren’t submitting the application for the finance, surely they need to then pay for your contracted wages for that period?

    I would be angry if they tried that with me so I really sympathise with you!
    Have you got it in writing that they are going to take you on on contract after the pandemic?

    edit it so your name is blanked out to begin with, although granted forum name gives it away a bit too.

    Furlough is only optional so they can stop claiming when they want, if they need to pay you our not will depend on your contract. Although as an agency unless you had a contract with someone probably not at this time.
