    A 30 second browse of their site shows they have a very robust privacy policy which cover how they collect and process your data.  Read the section headed 

    What information is collected and for what purpose

  • Is there any way of checking whether this was in place when I signed up (over a decade ago). I suspect it wasn't, as gambling regulations were much less stringent back then. And, if it wasn't, whether I have since agreed to it? I suspect I probably have, but don't actually know for sure.

    It may not have been, but you would have been advised to check for updates from time to time.

    Out of interest, what can't they get from an affordability check with Experian that they would get with a credit check? Because if it's all the same that seems like a massive loophole.
    I don't know for sure, but I would very much doubt there is any difference in the information available to Experian.
    What data they are allowed to share is another matter, but if the T&C say something along the lines of "we check various databases and they will share with us relevant details" then they can probably share anything. They don't have to say that it's Experian and that the database is your credit file and that relevant details will be loans.
    I don't know if you can complain, just because they found out information that you wish they didn't.
    But if they did a credit check then you can complain as that does harm to your credit file.
    I imagine the bank statement could be used to both prove to experian who you are and that you agree to the check. Why would they have one of your bank statements if you didn't.
