Hi All trying to get some advice. I booked a holiday in January for my 50th in October to Iceland and New York. We paid £770 deposit and stupidly never took out insurance . Due to covid we don't feel safe flying or want to go to New York were they had it bad and all the things we wanted to see are shut till the end of the year anyway. We're due to pay the rest of our holiday in July which is over £2000. If we cancel we will probably lose our deposit but as we paid on a credit card can we claim a section 75 for it?.  We'd be very thankful for any help as we cant afford to lose that much money.  Thanks

No. Section 75 give you the same rights against the card provider as the retailer.

It's not an insurance policy against change of mind.

If it was booked as a package this may give you some cancellation rights (with full refund) if any of the flights or accommodation are cancelled or changed significantly, so you may end up being able to pull out without losing money, but chances are you'll have to gamble on whether or not that happens (i.e. whether or not to pay the balance) - unless the provider is happy to delay the balance payment, you'll have to stump up for the rest or be initiating the cancellation yourself (have you checked the cancellation policy?).

The bottom line is that if YOU cancel it you cannot claim but if they cancel it you can.
