They will charge you the same either way. Most people would not find it hard to interpret that as them not being particularly bothered.

However, many people would deem it preferable to have the car they're driving around in properly maintained. And many would also view maintaining the warranty of the car as having a benefit.

Doesn't really answer the question though does it?  Given that I cannot get it serviced at VW then they will find it difficult to enforce a charge.  In any event, any charge will have to be a reflection of the loss they suffer.

I've asked them to confirm which they prefer.

You CAN get it serviced at VW. You just do not wish to travel very far to do so. You've chosen to set your upper limit at somewhere between a 40 and 75 mile radius. I presume you live somewhere fairly remote, like the further fringes of Wales or Scotland?

I presume you've used VWUK's portal to try and book a service?

As I said at the outset, I can't until September (earliest). Yes, in a fairly remote area.
Unfortunately, the portal isn't actually a booking tool. You get a response from the dealers.  Both of whom have advised September - 2 months past the scheduled service requirement.
  • Oh, and the dealer who is 75 miles away - again September.

Email your local dealers and ask for a date for a service, keep their replies quoting these Sept/Oct dates.
Get it serviced at a VW specialist and ask them to only use and invoice you for genuine parts.

When/if VWFS try charging you for a missed service, open a dispute with VWFS and when/if they turn it down open another with  BVRLA's ADR service,
    https://www.bvrla.co.uk/consumer-advice/making-a-complaint-adr.html
Copy them in on the servicing dates quoted by both dealers and the invoice from your specialist.

Explain you chose to try and maintain their car in a roadworthy condition when their dealers couldn't due to Covid 19 and the lockdown.
You have a contract and they have a code of practice, in this case neither of you could follow through at no fault to anyone.

I appreciate that it is a breach of the terms but my issue is that the car won't be serviced in time anyway but it will be quicker to get an independent to do it.   What would their loss be?

Financial. Buyers expect a car to have main dealer stamps in the service book for the first 2-3 years. Without those it makes a car harder to sell and people will want to pay much less in comparison to one with a book full of main dealer stamps.  Given how many millions of cars have been sold on PCP the used car market is flooded with them so buyers have plenty of cars with full main dealer service history available to buy.

    Great plan.  Thanks.

they would only be able to claim financial loss.  My query is what would that be.

Would it be useful to check if VWFS would be happy with a SEAT or Skoda service? There may be one  of those closer to you and with a better date.
