House has been in negative equity. Only just come out of it just about.  I am legally entitled to equity yes but as i havent lived there for 10 yrs the question is do i want it.
I really don't understand why these things are not decided at the time of the divorce.
Anyway, with no legal agreement, you both own half. That means if he sells at a loss, you are liable for half the loss.
The selling solicitor will distribute equally to both signatories unless you can provide legal documentation to vary.

There was an agreement he would take me off when he could. I went bankrupt so any negative equity doesnt lie with me
Im not interested in any profit i just want rid of it.  My question is am i being taken as a mug being told he cant get my name off it ? Makes no sense. Then he has the audacity to ask me to confirm i dont want share of the equity when i put £10k deposit into it. Its a mess. I just want out.  Hopefully sooner than later now its up for sale.
'When he could', is a terrible agreement to sign. Did a solicitor not advise you?
What has prompted the sale? He (and his girlfriend) may not want to own the house. That's understandable as it is likely to have lots of memories. So selling is logically the only way of honouring the agreement.
You say you don't care about the money, but then call him audacious to ask you to confirm that.
I sense a degree of hostility. Even the title of the thread gives me that impression. I know it's hard dealing with an ex (have one myself), but try to put your emotions to one side and it will be over all the sooner.

Well that explains in part why your ex has had a problem remortgaging the property. Now it's not.  Appears that matters can move forward. The property is for sale. Chill and let events take their normal course.

Another who has tweaked the first post without realising it's been quoted.

Either day you want the £10k, even though you haven't contributed and also went bankrupt (to avoid the negative equity?) Or tell him to keep it and just get it sold so your name is off the mortgage and deeds.
Mortgage started 2020, aiming to clear 31/12/2029.
  • The thread was going nowhere.

Thanks all, not much help really.
