My Mother passed away last year, probate is still ongoing, there is a debt to pay off on the property, but once probate has gone through this will be paid off, can a family member live there rather than it being an empty property.

If the executor approves, yes. Having a property occupied is better than leaving it empty, providing that the occupier is not going to cause a problem once it is time to move out.0
