Item not collected
I ordered a Hoist to be fitted in my car. The equipment was delivered to me and an engineer was due to fit it in my car a couple of days later.
Unfortunately lockdown kicked in before the engineer could call.
The company then refunded me the full amount I had paid, even though I had not requested a refund. The equipment was not collected and is still sitting in my hallway.
I have sent an email to the company as they are not taking calls.
Where do I stand, do I keep the item in the hope that the company will get back to me to collect or fit or is the item now mine to do with as I wish.

Why don't you try asking on the consumer rights board? They will know the answer.Edit to say this has been moved from a random board to the appropriate one.1

It's not yours to do with as you wish, and they have 6 years to chase you for the money.
If you fit and / or sell it you will be liable for the cost of the kit - perhaps the company have temporarily closed down due to that pandemic thing that's still going on?
I know of a lot of companies that are still completely non-operational - if everyone is furloughed, there's no one to arrange pickup or answer your emails etc.1 -
Thanks for the info, their website says they are answering emails but not phone calls. Just a pain having to squeeze past the big box to get in and out of the house.
Take care and keep safe0 -
Is there anywhere else you could store it? You have a duty to keep it safe, but if it is massively inconvenient you need a plan B.chris58000 said:Thanks for the info, their website says they are answering emails but not phone calls. I would email again, stating that you have been looking after their property for X days, and as it is such a big box it is hugely inconvenient to store, so could they arrange to pick it up in the next 14 days. State that after these 14 days, you will either be charging storage of the item at £X a day (no idea what is reasonable) or selling the item for whatever reasonable price you can get and will transfer the money to them.
We did this for a wardrobe delivered in error (we got 2 but only paid for 1) and it was surprising how quick they collected it once I threatened to charge them or sell it. They then wanted me to take it on a 50 mile round trip to a courier depot (er... NO!) so they came and collected it.Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)1 -
In that email did you explain that they have refunded you the money?chris58000 said:I have sent an email to the company as they are not taking calls.
Do you still need the item?
