Spitting

A neighbour insists on crossing the road past my property and spitting into my plants. I do have him on cctv and have been watching out for him and he spits more often than not. Should I go over to his and speak to him? What can I legally do?

Does it cause an issue? Although spitting is not very nice not sure what he is doing is illegal.0

Spitting in public can be treated as littering and although it is possible to take out a private prosecution, I can imagine that the cost, time and effort involved wouldn't really be worthwhile.0

Legal action should be a last resort. I'd speak to him,as non confrontationally as you can manage. Perhaps say that when gardening you are concerned that his spit will be on plants you handle and in the current situation that is a distinct risk.2
