Hi my parents bought their house from local authority in 1983 in right to buy. They passed away in 1990 so myself and my brother changed the title into our names. My brother recently passed away so the house automatically changed to my name. I'm now selling the house. I've hit a problem. My solicitor tells me there is a 5 year charge on the title this needs to be taken off by the council and that the land registry won't accept the new owner while its still on . The council phone lines are down due the covid. So emailing is the only option. My question is will land registry accept the deeds with this expired charge before the new owner can be transferred onto the title. Not that I don't trust my Solicitors but it wouldn't be the first time they've got something wrong. Sorry its long winded. Any advice on this would be great.

Yes its to prevent selling the house within the first 5 years of ownership.0

We've decided to transfer the title with the charge. It's proving difficult getting hold of the local authority and land registry. So fingers crossed land registry don't pick up on the charge. It did expire in 1988. The charge is void now, so we'll see.0

Hi all just to add incase someone else comes across this problem. The local authority told my solicitor that the land registry will automatically take the 5 year charge off.1
