Removing default paid CCJ

Hi we are looking to remortgage but my credit score is low. I paid for a full search with check my file and it has revealed a CCJ I was unaware of. I was aware of the initial ccj letter but thought that the CCJ was cancelled. Basically I brought a boiler and due to a bulging disc meaning I was unable to work I fell behind with payments and received the initial letter saying a CCJ was being brought againt me. I immediately went to the merchants and set up a repayment plan of £200 x 4 monthly payments. As a long standing customer they were completely happy and told me they would cancel any further action. I made the first payment that day and then the next 3 in plenty of time. I recieved a letter saying the balance was paid in full and all payments show on my bank statements. I never gave it another thought until I discovered the CCJ default ruling yesterday. We are desperate to remortgage and extend so our children can have separate bedrooms. Can anyone offer me any advice? Many thanks!

    You can get the judgement set aside by consent, this means you must obtain a document called a consent order, if you have legal representation, they will do all this for you, the claiment must sign the order, its then put before a judge to deceide yes or no, usually its a yes, but sometimes they require more information from you.
    Without legal representation, you just need Google, obtain and complete the form yourself, get the claiments signiture, put it before the court.

    Only way to stop a CCJ is pay in full within 21 days (and say this in court). No plan Pay in full. Anything you get now is good will. However having paid they have no reason to do so. Maybe if you pay all the costs, but unlikely even then.

    Sounds like you did not underatnd the process and though a payment plan that late would help.

    Get an adverse credit borker. If it's low any the only thing it should not make much difference.

    Have you actually spoken to a broker or are
    you just looking at the (fictitious) number on your credit files?
  • No hands up we didn't understand the process at all. The company said they would cancel it. I think they would be happy to fill in the consent for it to be set aside to be honest.  Ive googled but can't find this form only the N...something or other!
