Child benefit whilst living in Spain?

My brother moved out to Spain nearly 3 years ago with his son - he was know wondering if he can still claim Child benefit from this country and if so can it be backdated?

If you live in Spain you can only claim child benefit if you are working for a UK company and paying UK tax. I knew several people legitimately receiving child benefit whilst living in Spain but often Dad was working on the North Sea oil rigs or something similar. Best to phone and ask I would think.

I thought that if moving to another country you are leaving your country behind so why take from the british taxpayer when your not here anymore? Thats a cheek really.

Thats cool, can't he claim it there? maybe if he needs the money he should come back home until the child is older and then go back?

Any migrant worker from the EU living and working in the UK can I believe claim child benefit and tax credits for children not domiciled here in the UK. This would be the same principle for someone whose children are in Spain.

I do believe the goverment are currently reviewing this and it may stop soon, about time too I say

There are some Benefits you can claim whilst abroad, I do not think Child Benefit is one of them unless as someone has already pointed out, you are working for a UK company.

If your brother is working in Spain (or running a business) he may be eligible for the Spanish equivalent of UK child benefit. You'd get better information on one of the Spanish expat forums.
