Thanks again for you comments just to reiterate they could not get affordable life insurance when they got the mortgage it was something they were going to review when their mortgage deal ended obviously silly but hindsight is a wonderful thing. In answer to chanz4 the house was transferred into her sole name just after he died but will check if the land registry was updated. She has it in writing from the agent that she is not responsible for the debt, we have told them several times she did not request voluntary surrender and has no interest in the car plus she is not his executor. We have offered to send them the mortgage statement but they said she does not need to prove there isn't an estate as what we have told them is enough . The issue is that they say they can't collect the car without her completing and signing the voluntary surrender form which states that as executor she has to appraise the condition and arrange for any unacceptable wear and tear to be rectified (there are no known problems). The car has not moved for 10 weeks it is not taxed, insured or registered to anyone because they told her to notify all the relevant companies so how they think she could get any repairs done is ridiculous especially as she has it writing from them she is not responsible or liable.
We have now escalated our complaint to the ombudsman, my initial inquiry was to see if anyone knew whether she could move it to the public highway because she has been storing it for 10 weeks free of charge for the finance company and cannot use her drive for herself0 -
The widow is not the administrator by default. It doesn't work that way.
She needs to tell them hat he died intestate and there is currently no administrator. They are free to take on the role if they so wish0
