Car Insurance

My friend had a non fault accident the third party accepted liability, thethird parties insurer paid for everything including a new car seat and there own insurer also sent them a cheque for a new car seat, Hastings was there insurance at the time and are now trying to get the car seat money back, they are no longer with hastings, do they need to pay it back?

    I expect so, yes. Why wouldn't they?
  • As it was 8 months ago and they are skint for obvious reasons, can they offer a monthly amount to pay back, im sure if they offer something they can not refuse there offer

    They have been compensated twice for the same claim, so of course they have to pay it back.  They should have informed their own insurer that the seat had been paid for by the 3rd party insurer.  Hastings can refuse to accept monthly payments as they might argue that they have been defrauded by the customer.  They may also find difficulties getting insurance in future if Hastings, or the 3rd party insurer, put a flag on their history about this.

    Definitely needs to be paid back - and should have been when it was first spotted - they need to be careful that they don’t get a marker put against them, as they might find difficulty getting insurance at renewal. If their current provider declines to insure them
    - what’s one of the first questions any new insurer asks you? Along the lines of ‘have you had any insurance policy declined or refused in the last three years?’ They might end up on a downward spiral over the cost of a car seat. If they are truly skint right now - it’s probably best to speak to the insurance company and say yes they’re happy to repay the money, and hadn’t realised it was an error, however due to the current situation they can’t afford the full payment instantly - and then see if there’s a solution that can be reached to resolve the issue. 
  • When it occured they did tell Hastings but nothing was asked after that, thanks for all advise will inform them it needs to be paid back.
