Redundancy - when does your notice period start from?

Options
Hi,

I hope that everyone is well and keeping safe.

I have a theoretical question regarding the notice period when being made redundant and would like to hear peoples' take on it.

I, along with a number of others, am advised on the 1st June that my job is under threat and that I have to go through the consultation period to discuss the various factors ie skills matrix, other job roles in the company (with 4 week trial) etc etc to see who will be selected for redundancy.

This consultation period goes on for, let's say for convenience, 2 weeks. On the 15th June I am told that unfortunately I will be being made redundant. Due to my length of service, I am entitled to 12 weeks notice.

The company tells me that the notice period starts from 1st June (even though at this point my job is only under "threat" and suppossedly no final decisions had been made at this time). As I see it, I haven't actually been made redundant until I was informed on 15th June (prior to that during the consulation period I could have aced the skills matrix, been offered another role etc) so I feel the notice period should start from 15th June.

Again, this is completely theoretical but is something I have been thinking about recently.

Thanks again, everyone.

  • I've just gone through this and the notice period should begin from the end of the consultation period (this is what we were told and this is when the notice period began for those that were sadly made redundant)

    From Acas:

    When the notice period starts

It's a good idea to check your contract as it might say when a redundancy notice period starts.

If your employer gives you redundancy notice in person, your notice period should start from the next day.

If you're given the notice by email or post, your notice period should start when you've had time to read it.

For example, if you're told in a letter sent by registered post, your notice might start the day after you've received it so you've had time to read it.

Your notice period starts from the day you are told you are being made redundant not from the day you may be.  Otherwise every company will use that to reduce redundancy period, as some consultation periods go on for a long time.
