Thanks to you all for the info and insight, I've been reading the newbies thread and scrouring for the last week!

Well, this is pretty standard but the problem is in the order of events, hopefully you folks give me clarity?
This happened in Scotland.
1. Got ParkingEye PCN in Feb, and it's a GOLDEN TICKET (no POFA 2012 on the back)
2. I did not appeal it, I ignored it.
3. Got DCBL debt recovery 2 weeks ago.
Yeah I am ignoring the debt letter as has been recommended, but the next stage is ParkingEye will send a Letter Before Court Action, correct?
What would you do next?

A: Would you send an appeal or (non-appeal?) letter to ParkingEye, just pointing out it's not POFA compliant? What will they do then?
B: They send back a code to appeal to POPLA? But in Scotland, POPLA require you to state who the driver was, so what do I do next?
No complaint has been sent to the Moxy hotel because the driver was not a customer, the driver just didn't see the signage. What would you do?

As this is scotland there is NO chance they will file a claim, as there is never keeper liability
We'ev never known them to go to court after sending to a debt recovery firm.
Ignore, but file. Come back IF you get a never before heard of LBCCC or claim form for the simple procedure.4 -

Thanks! That's exactly what I needed confirmed.
So they have sent a PCN that is non-POFA compliant (sent outside 2 weeks) in Scotland, knowing there's no keep liability because they don't know who was driving, and then send a debt collection letter, still knowing that they can't do anything and rely on people who don't know this, to give them £170?
SO evil.

Update:
Received another threatening letter from DCBL titled "Final Reminder - Unpaid parking charge"
The 1st letter said "pay within 14 days or else we'll recommend to ParkingEye to commence legal action aginst you." that passed and this 2nd letter has no timeframe on it, only that "if a claim is issued, all claim fees will be added ontop of the parking charge."
What does this signal to you?0 -
It signals to me that you have not read the newbies thread wrt dca letters.You never know how far you can go until you go too far.1

It signals that they are no nearer getting your money than they were at the outset. There's no need for them recommend to PE that they should commence legal action against you, PE are the most proficient of operators in the country in issuing their own legal proceedings - without the prompting of a debt collector. As it's Scotland, the prospect of action through the Sheriff Court infinitesimally remote.Sleep easy!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Ignore. Debt. Collectors. That advice is in the newbies thread for a reason.
Still never known PE to commence a court claim having passed it along to debt collectors.2 -
I can confirm that I have not recieved any further letters. It's been 11 weeks.
Thanks everyone for sharing your accumulated research, experience and knowledge which I could not of done alone.

You realise P/Eye have 6 YEARS to litigate, and quite possibly will file old claims if the new Code of Practice curtails some income in the future? It is imperative that you keep all the paperwork and of course, make sure you email ParkingEye if you move house within the six years they have to sue you.PRIVATE 'PCN'?
