Furlough denied last paid week 23 Feb

Hi a job agency I have worked for a year denied me Furlough because the last shift they gave me was in week of 23rd Feb, for which I was paid 28th Feb. I did not leave they just ran out of shifts.
Any advice/ referencing of government principles is welcome. 
Also another casual job have ‘agreed’ to furlough me but said that it is not possible to backdate it now?

    If you had not received a P45 by 28 February from the agency, they should still be able to rehire you (if that is necessary) and furlough you, but they don't have to. See government guidance:

    "If you were made redundant or stopped working for your employer on or after 28 February 2020

    Your employer can agree to re-employ you and place you on furlough. They’ll still be able to claim a grant to cover 80% of your regular wages from the date you were placed on furlough, up to a cap of £2,500 a month. This applies if you were made redundant or stopped working for them on or after 28 February 2020, even if they do not re-employ you until after 19 March 2020.

    This applies as long as you were on their payroll on or before 28 February 2020. This means an RTI submission notifying payment in respect of you to HMRC must have been made on or before 28 February 2020.

    Find out what happens if you stopped working for your employer and were on a fixed term contract.

    I imagine the casual job cannot backdate your furlough because they will have already made claims for earlier periods.


    You only have today to get furloughed. After today it will be too late, if they haven't furloughed you before.


  • Thankyou, the 23 Feb job said that I was not on the payroll 28th Feb Because they pay weekly so do not count. They had not sent me my P45 so I was definitely still employed.

    They won't be able to furlough you now because the deadline was 10th June.
