Early years furlough

1 work in the Early Years sector at a charity run Pre school. We were furloughed from 20th March. We we’re getting 80% of our salary. We reopened on the 1st June but because of the low number of children attending only 4 staff have returned and the rest are still furloughed. Those staff that have returned to work are doing reduced hours but getting paid their normal wage. They have now said the ones still on furlough will now only be getting 60% of their wage from June. Can they do this or should they still be paying 80% under the government furlough scheme?

An employer must pay a furloughed employee at least 80% of their reference salary, or they cannot claim CJRS. See the Treasury Direction:
"7.1 Costs of employment meet the conditions in this paragraph if-
(a) they relate to the payment of earnings to an employee during a period in which the employee is furloughed, and
(b) the employee is being paid-
(i) £2500 or more per month (or, if the employee is paid daily or on some other periodic basis, the appropriate pro-rata), or
(ii) where the employee is being paid less than the amounts set out in paragraph 7.1(b)(i), the employee is being paid an amount equal to at least 80% of the employee’s reference salary."

I’ve just found out that our setting isn’t able to access the 80% from the CJRS. . It is getting 30% of the free funding for children instead. Just want to clarify. Does this mean we aren’t entitled to the 80% and if so they can pay us what they want?0

I am not familiar with the 30% free funding for children. You are entitled to be paid according to your contract of employment. What your employer recovers in respect of your wage under the job retention scheme or anything else does not affect this. You would normally have to agree to a reduction in wages. If you don't, the employer may decide it has to make you redundant.1 -
