Thanks.  i never considered there would ever be equity so he shot himself in the foot by asking me to confirm i dont want any of it.   The house is also co ownership so in reality any equity is going to be minimal.  He has also had lodgers over the years assisting him with payments.  Id be delighted with 5k but it seems unlikely.

£10k or half the equity left whichever is lowest is fair in my opinion. He had your £10k and joint liability locked into the property which enabled him to keep living there, I doubt he could afford it on his own. 

He paid all the mortgage in lieu of rent on your half, this likely saved him money and he had the benefit of renting out rooms. You were both foolish not settling this years ago.

Oh i agree with you i pushed to get it sorted but he didnt do anything about it.  Now i get the feeling hes regretting it.
