    The scaffolding could have been there all this time, even if the work had been completed in 2 weeks. It's well-known that scaffolders often leave their stock in place until it's required for another job, so the person who hires it has little control over removal.
    If it's any consolation, the replacement of a roof isn't regarded as new building, so your neighbour might have used the Access to Neighbouring Land legislation to gain access to your garden if there was really no other way of proceeding.

    But that permission expired now...it was for two weeks only and it is six weeks now....can be proven by text message

    You probably can't get the scaffolding taken down before the job is finished but you can insist that they fit some protection to the scaffolding so that nothing more falls into your garden.  That this wasn't done as the scaffolding was put up suggests the builders are verging on the cowboy end of the spectrum.
