Furlough Advice

Good morning all first post on here.

I'm currently on furlough pay from my employer and have received my payments from them, But since we was told to stay away from the office i have had no other interaction with my company.

Can somebody tell me what the regulations are in taking employees off the scheme as i am pretty sure that once my company has to start paying monies towards the furlough payment they will not do that and will start to make people redundant (The company was struggling beforehand)

Is there a notice period or can they just say for example (This will be your last furlough payment)

Any help would be appreciated

    the usual employment laws still apply. How long have you been with the company? More than two years?
  • I have been with them for 4 years now..
  • There is no notice period with regard to furlough, you must make yourself available for work as per your contract, they can bring you back to work at any time they wish. There is a minimum three week furlough period to allow them to claim, but they are still able to bring you back to work sooner if they wish, they would just be unable to claim for the funds for workers that they did so if the furlough period was shorter than three weeks. Saying "you need to come in now" would probably be regarded as somewhat unreasonable, although if it was to come in during your working day then legally acceptable, saying "come in tomorrow" would be fine if tomorrow was part of your normal working day. 

    With regard to being made redundant they have to follow their legal and contractual obligations which vary depending on the size of the company, number of people being made redundant and your contact.

    They could say to me today that the next payment at the end of June is my last, and then advise me of any return to work date or redundancy?
  • Yes correct, they can require you to return to work your contractual hours. If they make you redundant they have to follow the correct procedure based on the circumstances. That would normally begin by notifying you that your job was potentially at risk and outlining the procedure that they will follow going forward from that point, they are not able to just say "You have now been made redundant, goodbye", although for people on zero-hours contracts they do not need to do anything, just not give them any hours.

    The furlough agreement should say when it expires, and they can choose to renew it or not, without notice.

    The they can ask you to return at any time in normal work hours and with no notice.
  • All i want to do is go back to work, But obviously also want to know what their plans are regarding furlough.
