And don't be put off by their reply telling you it's legal.  Please don't ask for the next step, nor quote their argument to us (please, we don't want or need to read it).

The ONLY point of you asking this question about the £60 now, is to show your Judge later that you raised that it was unlawful and an abuse of process even before court stage.  Not to try to win the argument with an idiot!

  • Success!! Just an update with an outcome. Following a couple more letters to/from ELMS along with resending supporting evidence for my whereabouts, etc. I have received a final letter today indicating closure of the matter. So no court process required. I will send an email to update my local MP of the outcome as they had requested. Thanks to all the advice that was provided along the way, especially during a national pandemic. Much appreciated.

Great - as long as you mean the PPC has cancelled the PCN,  not just that Elms Legal has returned the file to the PPC to start again?

AND I AM SO PLEASED YOU CAME BACK NOW - please now make a real difference - A TASK FOR SEPTEMBER.

The Government is (this month only) consulting about a new statutory code of practice (CoP) and framework to rein in the rogue parking firms.  Read and comment on the draft CoP proposal and the enforcement framework consultation, and get everyone you know to do the same.

You will need to register to comment on the CoP and enter an occupation even if you are retired or a homemaker, but otherwise it is easy to navigate, and comment upon each section/subsection individually. You can save comments to edit later and or submit comments once you are happy with them.

    https://standardsdevelopment.bsigroup.com/projects/2020-00193#/section

You do not need to register to comment on the enforcement framework which can be found here. It has a link on page 5 to make comments.

At the very least, we say the parking charge level should be £50/£25 or higher level £70/£35, as per Council PCNs in E&W.

And we say the added fake 'debt recovery' costs are just double counting the cost of letters, and MUST GO because that is unfair and illegal.

Please be heard.  You can bet the hundreds of PPCs will be commenting.

No apologies for repeating this vital 'call for action' to consumers, on every thread this month!

  • On review I think it’s more the latter as the wording is quite vague and states ‘our client has now instructed us to close the matter on our system and we shall not be issuing a claim’. So I’m not 100% sure the PCN is actually cancelled but it may be worth sending a letter to the PPC again to highlight any further correspondence other than to acknowledge cancelation of the PCN would be harassment. Thanks for the link, I will definitely contribute to this.
