Two terms and conditions on Lastminute.com

There are two terms on conditions to be found with Last Minute .com. Which terms and condition would apply? 
The one found on the terms and conditions section of there website states:
    Amendment/cancellation by us or the airline
    1. In the unlikely event that the airline cancels or amends your booking (for example due to scheduling changes), or is otherwise unable to fulfil your booking, we will use reasonable efforts to contact you as soon as reasonably possible using the contact details you provided at the time of booking. If the airline is unable to fulfill your booking and is unable to provide an alternative, your booking will be cancelled with a full refund.
However, the terms and conditions when booking states: 

4.4. BOOKING CANCELLATION OR MODIFICATION BY THE AIRLINE OR FLIGHT PROVIDER

In case the airline or flight provider cancels or modifies the flight you have booked (for example, they change the schedule), you have the right to a refund of the price of your plane ticket and/or some other type of economic compensation in accordance with European Commission Regulation no. 261/2004. For more information on your rights, you can consult <link>. We inform you that the application of a refund or economic compensation is the exclusive responsibility of the airline and that the Company is not responsible for such under any circumstance.

In these cases, the Company will assist you in getting the amount of your plane ticket back (not any subsequent compensation, which you would have to directly ask of the airline) by acting in your name and on your behalf with the airline.

Keep in mind that the Company’s agency fees are independent of the price of your plane ticket, and for this reason you do not have the right to a refund of the amount paid for such services from the moment in which you make your request. This is because our agency fees cover the Booking Service supplied by the Company, which have been successfully carried out after having assisted the Customer in making his/her booking via the Web Application.

The Company can apply an agency fee for the reasons stated in the preceding paragraph.

    Last munute.com refund the airfare but any claim for compensation under  European Commission Regulation no. 261/2004  must be made direct to he airline by you.
  • My point is one terms and condition says full refund the other says full refund minus admin fee for a flight cancellation.

    I was fortunate to just get in under the wire for a cancellation in mid March. This was because of the collapse of Flybe rather than Covid. I got a full refund (hotel and flight) with no admin charge.

    Subsequently, lastminute just seem to be doing all they can to wriggle out of refunds whether with an admin charge or otherwise. Trustpilot Is full of scathing reviews.  Should you ever be able to communicate with them I'd ask which Ts & Cs they are applying and why.

    Does the first one  mean  that  if thee airline cancel then the airline will give a full refund but as you have booked through Lastminute.com the refund will come through them and they will charge an admin fee for processing it.
