Redundancy And break in service. Also info on reason for Redundancy.

Hello

This is for a friend who is not great with electronic things at all. Anyway the main part of the question is that he has worked for the company for over 12 years but had a breach for just over 5 months. So if he is made redundant will it only be taken on the last 3 years or will it be assessed on the 12 years?  Thank you for any help forthcoming as he has got a meeting next Monday to discuss it with company staff.

Right he received a letter telling him that during this epidemic they have had a downturn in work and have had a look where savings could be made and his job as a yard man/second man is a position that they could in effect manage without. However he spends 95% of his time being a second man. And if he was to be made redundant then they would have to send a fully qualified person as a second man on jobs. Which would mean that there is one less fully qualified person in the yard to do another job should one come in. Plus the company would be paying the fully qualified person a extra £2:00 a hour whilst doing the second man position for which he knows there is still plenty of work for. He know this because he talks to the person that his company do all the work for. So does it make any sense that they would want to make my friend redundant? .They have also said if he can think of any reason the company should not consider you for redundancy?. Iv told him to just go with what Iv just said. But if anyone else has anything to suggest then please do..

Many thanks Osh

It would depend if he was still employed by his employer during the five months break  If he left the Company and rejoined five months later then he only has three years of service. If he took a five month unpaid break but was still an employee of the company it would be 12 years service.

No idea on the second point I’m afraid but once people have been picked for redundancy it’s hard to overturn it.

    The first part as above
The second part, they need to save a body basically, so them paying the other person £2.00 an hour more whilst they do the job your friend does normally is still a saving for the company. They can get the other person to do other work too as they are qualified which they can't get your friend to do.

Bottom line is that if there's insufficient work for the entire workplace. Then a plan would have been drawn up as to how to reduce the overall headcount. Yet still get all "jobs" done.  With other people being deployed to cover as necessary.  The aim is to save money and reduce operating costs. Hopefully the business will survive and in due course expand it's operations again. Redundancy as harsh as it seems isn't to be taken personally,
