I could really do with some help and advice regarding a booking we made for holiday and what our consumer rights are.
My partner turned 50 this year and we wanted to book a holiday with our children to DisneyLand Paris. The holiday cost just over £2500 for 4 nights including flights and accommodation, paid on our credit card. We booked through the COOP travel agent in our local town. We did this because we wanted to ensure it was a package and we were protected should something go wrong.
When we booked we believed the flights were with AirFrance, it hadn’t been explained to us that we were actually flying with FlyBe and AirFrance were just the agent for this flight.
After FlyBe went in to administration on the 5th March we received a call from the COOP travel agent explaining this and they offered us a couple of different options, either change flights at a cost of over £500 or have a full refund. We opted for the full refund, which they agreed and said would be processed within 14 days.
We are now in June and we still haven’t received any money back, every time we chase COOP travel they blame Disney and the coronavirus for the delay and say they can’t refund us until Disney send the money back.
We have chased so many times and it’s really getting me down. We’ve told the COOP if we don’t get our money back we’ll do a section 75 chargeback but they’ve replied and said we can’t do that because they are just the agent and it’s in their terms and conditions until they get the money back from Disney we just have to wait.
Its been 3 months and I feel like we’ll never get our money back. Do anyone have any advice of what we can do? Should we do a section 75 charge back? Contact Abta or Atol? I’ve even thought about a small claims court as a last resort. Any advice would be gratefully appreciated!!
