Laura Ashley administration

We purchased 2 couches in Laura Ashley's in January and as we know they have gone into administration. The goods were purchased on a Laura Ashley credit card of which I opened on the day as they offered interest free credit. I have made contact with them on numerous occasions re my concerns and I was assured that I was covered for a refund as I had purchased with a credit and that I could arrange this through the card provider Newday. I was also informed by Laura Ashley that my goods were in their warehouse ready for delivery but due to Government guide lines due to the Corona virus they could not deliver. I contacted Newday dispute centre to set in place a Section 75 and I was informed that I may or may not get all my monies back. I inquired why this was as I thought I was covered by purchasing with a credit card (Master Card) and they informed me as it was a "house" card this may not be the case. This I can only assume is that the card is a Laura Ashley card. Newday informed me that the would contact the administrators (PWC) and if they were not successful in getting a refund from them, they would notify me to make contact with same. Today I received an email from Laura Ashley informing me that they could not fulfill my order and that any purchase made before 23rd of March would not be refunded.
I'm confused now as to where I stand, it's not the start to our retirement we expected.

Stay Safe

Kind regards

Gerry

New day will have to honour the S75 request or a chargeback if you're not getting your couches.
They will go for a chargeback first then if unsuccessful you need to start a S75 claim
  • First contact Newday and ask them as above. Chargeback if possible (probably no funds left at LA so not possible) then S75 where Newday must pay.

Any hassle or problems tell Newday (nicely) you would like to raise a complaint.
  • Oh thank you so much for getting back so quick, I have touched base with Newday and the have initiated the S75 with the administrators. I'ts good to know that someone will have to make good and I won't be out of pocket.
    Stay Safe and thanks again.

Just to be clear, s75 holds the creditor (Newday) equally as liable to you as the retailer would be - whether or not they succeed in recovering anything from the retailer or their administrators is ultimately irrelevant to the customer, it's Newday that owe you the money.

The fact the retailer has no funds, has no effect on a chargeback. The money comes from LA bank. How they get it back is their problem.

Interesting as not the 1st time we had heard that response from Newday on LA cards.
    Life in the slow lane
  • RESULT. Full refund from Newday, thank you all for taking the time to reply to my query. Stay safe.....
