I suspect that would be seen as a condition they were imposing before supplying their consent.tfc12345 said:Thank you - they had continued to suggest or heavily imply that payment was 'needed' to draft and agree to a consent order - however, this is not the case apparently reading above and seeking independent advice
Are they allowed to do that - wouldn't that be deemed to be predatory/misleading tactics?
Both parties are free to add conditions to any agreement before that agreement is made.3 -
Have you cracked on and applied for the set aside now, and paid the £255 fee and attached to your N244 the usual witness statement and Draft Order, inviting the court to order that the £255 is paid by the Claimant after the hearing?

Yes - claimants indicated willingness to consent form then stooped responding
Have explained this and that this delayed application
Just apprehensive as may now require a 'hearing' for set aside which would be unexperienced with

Most people have no experience in set asides , IMHO
It is what it is , something that you learn about , try to understand , and deal with accordingly
I am sure that the most experienced pilot in the world was apprehensive on their first try at flying , plus this was the first time Sully landed an Airbus in the Hudson , despite vast experience and knowledge , it was still his first time

Almost everyone here hasn't been through set asides before they come here. Do your research.3

And read the ones I've already linked as 'set aside examples' in the NEWBIES thread 2nd post - that's why they are there in the sticky thread. Both won at hearings recently, and got their £255 ordered to be paid by the PPC.
Also read the recent one by @Chucky1000 where his/her son (the D) got his £255 ordered back AND the entire claim was struck out.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
