Part time zero hour contract

Hi there, If your currently furloughed and working both part time and full time for the same company, would your furlough payment change when you do part time and when you 
do full time, as at say half term you wold work full time then through the summer holidays you would work full time, or would the payment stay the same many thanks.

    You are probably a variable pay employee, so your employer's claim (the minimum you can be paid) would be as follows:

    Employees whose pay varies and were employed from 6 April 2019

    If the employee has been employed continuously from the start of the 2019 to 2020 tax year, you can claim the highest of either:

    • 80% of the same month’s wages from the previous year (up to a maximum of £2,500 a month)
    • 80% of the average monthly wages for the 2019 to 2020 tax year (up to a maximum of £2,500 a month)

    Any variation in payment would be as you agreed with your employer when they consulted you about being furloughed.

    In the absence of any variation of agreement, the employer is still obliged to pay you in accordance with your contract of employment they agreed with you previously.

    My company has decided to pay 80% of our pay but have included mileage allowance in the calculation, which means it takes me over the limit to claim. I am a zero hrs worker and think this is unfair , but is it right ? my company are American and say they will not claim off the government .

    The claim is capped at £2,500 a month. There is no limit that prevents a claim. Theoretically an employer could furlough a footballer paid £1 million a month and still claim £2,500 from HMRC.

    Always wondered about this in that with a 0 hours contract there is no obligation to do anything even furlough. The inclusion of the "average" pay within the furlough scheme appears incredibly generous but recognises the structural flaw in having so many of these contracts in the economy.

    Leaving that aside, if you think anything is unfair, look at your contract of employment for the dispute mechanism and raise it that way. Will be your grievance process.

    • "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere
