Unfair furlough?

    I think part of the problem is that she would never work in that period anyway because she is a term time employee.

    Her monthly pay is technically lower because of the way term time pay works so 80% of that even more so.

    HMRC I am sure will eventually do audits for all the furlough scheme applications and when it comes to light that they applied for furlough for an employee who wouldn’t usually work in that period of time anyway is made it won’t be looked upon too kindly.

    The government will be footing the bill anyway as if they recalculated it she would get higher each month anyway so in practical terms probably no difference.

    Affectively she has already worked the hours so the before the furlough period (summer holidays) because she only works term time.
    she gets a reduced monthly wage spread over 12 months rather than go periods without a wage.
    so she has worked the hours and In theory her employers have had the work from her for free as the government will pay her 80% so she is 20% down the government 80% down and her company 100% up

    If that is her normal holiday period it is the same as anybody who is on furlough and have to use holiday, the government pays the majority of the bill.

    It’s not a holiday period.... she is only contracted term times. However her pay is all year round but reduced to compensate and so she doesn’t miss months... she is not contracted half terms

    There was a thread a bit like this a while back where someone working at an airport worked excess hours in Jan/Feb an usually had rest days in Apr/May rather than being paid overtime. The view was he should be paid 100% as he did work those hours.
    Is this a similar situation? She works 38 weeks a year (10 months, give or take) but is paid 12 equal monthly wages. If she’s done the hours and is not due to be working at all over summer I’d say she should be paid 100%.

    Yes she’s classed as part time doesn’t receive holiday pay etc

    I'd push for them to top up the last 20% - then everyone wins. She gets her usual wage and they get a reprieve in their wage bill.
