SEISS rejection after 2 reviews NEED HELP

hi all

i submitted my return before the deadline but as my regular account died last year i did it myself but apparently did it wrong. i got a call on april 20th 2020 from a nice lady at HMRC and she told me what id done wrong and to amend my return before the 25th and it will be fine for being assessed for eligibility. i did it straight away as it was a basic error on my part and was sent for review, got another call a couple of weeks ago saying it needed to be reviewed again and today i received a letter saying that because i had amended my return (despite it being instructed to do so) i am no longer eligible for SEISS.

is there any advise people can give me in regards to appealing this? i did what i was asked to do and meet all the criteria for eligibility, i cannot go back to work as my partner is shielding.

    Amending your return does not disqualify you from receiving a grant under SEISS. What you were apparently not told, and what was not made clear until rather later, was that any amendments to a SA return after 6pm on 26 March 2020 would be ignored for the purposes of calculating the grant available under SEISS. See paragraph 10 of the Treasury Direction:
    "10. For the purposes of SEISS, amounts of trading profits and relevant income are determined by reference to a person’s tax returns as at 23 April 2020 but no account will be taken of any amendment made to a tax return on or after 6pm on 26 March 2020 or any contract settlement."

    It may well be that the result of that rule applying is that you do not qualify for a grant under SEISS. We don't have the information to be able to comment.

    That's not strictly correct. The amendment is ignored for SEISS, which may well result in the same outcome.

    Previous tax returns? Amount declared? As others have said amending your tax return does not in itself render you ineligible!

  • The same thing happened to me - I am awaiting amends being made to my tax returns, but was told by the reviews team that the deadline had already passed for me being able to amend my records in time for the SEISS grant application and the further review I requested.

    I was told by the (admittedly friendly and helpful) person on the review team that the only way things could change for me would be for there to be a change to the SEISS rulings in terms of that March cut-off date. So I;d be interested to know if Martin and/or MSE can help in terms of lobbying on the behalf of those who have been affected this way when technically they are self-employed and entitled to this help...

    Martin doesn't ever post on the forums. It's also very unlikely that they will change the rules for the SEISS now.

    The march cut off date is already very generous.  It would have been entirely in order if the government set the rules do that only tax returns as submitted by the normal end of January deadline could be considered.
