Apple not under warranty?

I purchased air pods last April.
I lost the left one.
I bought a new one for £65 in November from apple which is faulty.
I was told that the new ear piece doesn’t have a year’s manufactures warranty and that the new ear piece is some how linked to the AirPod charging case. (Bought from Currys)
I said I want to complain and was told there is no one to complain to and that the decision from the person I spoke to was final.
I want to go to the legal ombudsman but I think they require a written decision from apple as to why they won’t fix the item I bought direct from apple. However apple support won’t give me a written answer to my support query - so I’m going round in circles and honestly am so frustrated
I have also contacted the Currys where I bought the original AirPod unit from, they said they won’t repair or replace the unit as I bought the faulty AirPod from apple so it’s nothing to do with them.
Yes the AirPod charging case might be 14 months old but the faulty AirPod that I bought is not. And it was a unit I bought, not a repair. Nothing was repaired.
No one explained I only received 90 days warranty.
It just seems really poor taste from apple

Exercise consumer rights rather than warranty. That may require you to have the faulty pod inspected to verify the fault and hopefully show it's an inherent fault. Then Apple have to act.
You have no argument with Currys. The item you bought from them works perfectly and they're right. The faulty pod is nothing to do with them.0 -
I dont see how its currys fault-2

It’s so ambiguous
using their logic, if I bought a new charging case would that make my old headphones back in warranty!? Lol
Apple say they don’t sell the separate earphones... it’s classed as a ‘repair’ to the charging unit
I feel it’s really poor from them0 -
Airpods are sold as pairs. Is it possible that replacement ones sold singularly are actually refurbished and therefore only have a 90 day warranty? It sounds like something Apple would do.Braquo99_2 said:Yes the AirPod charging case might be 14 months old but the faulty AirPod that I bought is not. And it was a unit I bought, not a repair. You can buy Airpods singularly from Apple and they are supplied as new items and not refurbishedSupersonos said:Airpods are sold as pairs. If you lose an AirPod or your charging case, you can purchase a replacement. Your replacement will be new. AppleCare+ for Headphones does not cover lost or stolen AirPods.AirPods Lost fee AirPods £ 65 each 0 -
They say they’re not replacements.... they are a repair to the charging case and that’s why they are not covered under their own 12 month manufacturers warranty0

As a warranty is something that is in excess of your legal rights, it is perfectly legal for Apple to state this.Braquo99_2 said:They say they’re not replacements.... they are a repair to the charging case and that’s why they are not covered under their own 12 month manufacturers warranty
This doesn't detract from your statutory rights as mentioned by Aylesbury_Duck but going down this route could well involve a lot of time and effort for a relatively low value item.0
