Hi all and thanks for taking the time to read this.
In 2008 I took a £12,000 loan from Natwest because I had broken my leg and was unable to work. I was repaying £200 pm until around 2014 when I suddenly began to have serious income issues. After going through lots of personal problems and failing to keep up with my repayments, Natwest defaulted my account and issued me with a ccj. Natwest then instructed Shoosmiths LLp to recoup the money and placed a charge order on my property. Things were not great, however, I was determined to turn my life around and agreed to set up a direct debit with shoosmiths LLp for £50 each month. The years passed as I rebuilt my life, never once missing a payment in almost 6 years. In November of last year I had saved enough money to pay off the remaining £1900 in one go as a full and final payment.
Last week I applied for a new mortgage. Myself and 2 children live in a one bed flat and desperately need to move. My Experian report shows 999 which of course is the best it can be. My mortgage applications were declined because of the old NatWest loan on my file. It states that every payment for the last 6 years was late by 2 months when I in fact paid Shoosmiths LLp every month without fail...
If there's anyone that knows what I can do, please help.
Thank you
Tommy

Yh I get what you're saying but my history shows that I did pay every month. The problem is, all payments are showing as 2 months late.
Has anyone else had this problem?

You will need to ask for the late payments to be removed, whether its successful I dont know but try it.1

Your files should show a monthly default.
If it doesn't, ask them to amend it. However, it will drop off your files after 6 years, so may not be worth the effort.1 -
Your contracted payment is £200 per month so you are indeed late. The fact you made an agreement with the legal firm does not mean that you have not broken the terms of the original loan agreement and your credit history is intended to show this.
However I agree with ZX81 - if the loan was subject to a CCJ it MUST have defaulted - otherwise the bank could not apply for one in the first place. In those circumstances the record drops off your file six years from the date of default. There is no discretion on this on the part of the lender and they have to correct the information for you. If they didn't default the loan then they could not have got the CCJ1 -
The score means nothing, its just a marketing tool for the CRAs to make money.
As for a removal of a reported information, if it is correct it must stay, as it's a accurate description of your repayment and management of the account.1 -
Hi Tommy,
One watch out for you would be borrowing from Natwest. I am a longstanding customer for both personal and business. They have their own "Credit Score" section on their app which I shown up as "Below Average" however on every other credit agency I have excellent credit/ 999 etc. When I questioned them on it, it was a simple "Nothing we can do" -
I remember 3 years ago, they wouldn't even allow an arranged overdraft on my account of £500. I have just accepted them being hard now. I have since got mortgages, credit cards and car credit etc with other high street lenders with no problem. I think they are notoriously hard with the eligibility.
I understand that it's an additional cost, however I would suggest getting a mortgage adviser. They know the whole market and which ones are likely to accept you based on your criteria. Save a lot of credit searches on your account and get you the best deal.
Wish you all the best for you new home with your x0 -
As above, the NatWest loan must have a "default date" against it on your credit file, and the date must be prior to the date they commenced court action in the first place.
If it does not show this, write to them formally requesting this be amended to show a default date prior to the court proceedings having begun. Explain in your letter that if they fail to do this you will refer the matter to the ICO.
If they haven't amended your credit file accordingly after eight weeks, escalate the matter to the ICO.
Well done for resolving the debt situation. Really great job. Good luck with NatWest. Keep us posted 👍0 -

The good news is the whole entry will drop off your file at some point this year.Check the default date on your credit file, see what month it defaulted.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
