Redundancy

Hi, I am on furlough and I have been contact by HR that I am at risk of redundancy and told that my notice period is running parallel with furloughed.
Could you please advise?

Until you have been told you are being made redundant the notice period does not start, at the moment it is only risk.1

Normal rules about employment contracts and redundancy rights etc all still apply. They still need to follow consultation process, etc. You have been told (perhaps verbally?) that you are at risk of redundancy. Notice period does not start until formally advised the same, and I would expect that has to be in writing. It is possible for the furlough to continue through the notice period (even though I think that is wrong).0

Being told you are "At risk of redundancy" is usually the first step in the consultation process, they are required to have a prescribed number of meetings with you and/or unions depending on the setup, number of people being made redundant etc. At the end of that process you will then either be told you have continuing employment, or that you are being made redundant, what payments you are entitled to or not (notice, holiday pay owed etc.), when your formal end date is, when your final pay date is etc.
I am not sure if they can claim your notice period as furlough pay from the government, I do not think that is allowed but hopefully someone else will be able to clarify.0 -

- The employer cannot claim redundancy pay against furlough.
- If the employer pays PILON, they cannot claim that against furlough.
- If the employer pays notice pay in normal pay-run cycles, then they can claim that against furlough.

I have had meeting with HR via Zoom And after that they’ve sent the information pack over. I have asked the question about notices period and I have been told my notices period is running parallel with Furloughed( End in June)
I just can’t get my head around this one.0 -

If you have more than 2 years service then you might add flawed redundancy process too.
And though I dislike them, Conditional Fee Arrangements with employment solicitors may be worthwhile. They'll be keen as they've not had much business lately.

- "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere

Are you sure you have your terms right - If they have told you you are at RISK or redundancy its morel likely that the redundancy consultation period is actually running in parallel with you Furlough, not your notice period?
