Leesa.co.uk ceased trading, Not honouring Warranty

Hi,
I brought a mattress from Leesa.co.uk back in January 2018, when I brought the item it came with a 10 warranty. The mattress also had a 'Which Buy' award which gave me peace of mind that I was supposedly buying quality. The mattress was awesome over the first two years, but unfortunately started to develop permanent sag which is what you don't expect from a £700 memory-foam mattress.
I tried to contact Leesa.co.uk and found that their website was no longer working and the following message was in place:
Leesa is no longer fulfilling orders or operating in Europe. For all inquiries and additional information please contact Lucy Duckworth at Lucy.Duckworth@cowgills.co.uk.
I contacted Cowgills.co.uk and explained my problem and received the following email:
Unfortunately, the Company has ceased to trade and has instructed Cowgill’s to assist the Directors with placing the Company into Liquidation which is due to take place on 21st May 2020. The Company is not in a position to honour any guarantees that it has provided to its customers. You will be able to make a claim in the Liquidation for the loss that you have suffered; however, due to the financial position of the Company and its assets, the current position indicates that it is unlikely that you will receive a refund of this loss as the Company does not have the funds. In order for you to make a claim you will need to compete the attached form and return it to me along with documentation in support of the amount that you are claiming. Once the Company has entered into Liquidation and following completion of our investigations and any asset realisation, should the financial position of the Company change in in any way, your details will be on our system so you will receive access to updates issued to the Company’s creditors. If the purchase was made in the last 120 days you may be able to do a chargeback on your credit or debit card and should therefore contact your banking provider in order to do this. Should you require any further information, please do not hesitate to contact me.
Is it just a matter of filling in the form and supplying them with proof of purchase and hope to get a refund, or is there anything else I can do to get my mattress replaced? I know that Leesa.com is still trading in the US, would this make any difference?
Thanks Lee

I'm afraid there is, given the time frame passed, nothing you can do about this. I wouldn't waste further time on the claim to the liquidators, there won't be anything much for you there.1

Who manufactured the mattress? If it was Leesa then you are probably wasting your time as you will be low down on the list of creditors. If the manufacturer is still operating I'd speak to them.1

If you paid for some or all of the cost of the mattress on a credit card or on finance then you have the option of pursuing the credit provider under Section 75 of the Consumer credit act.
Basically, this part of the act states that the credit provider is to held equally liable along with the seller of the goods should there be any breach of contract and failing to provide a warranty that was given as part of the purchase definitely falls under this.

@shaun_from_Africa I paid via Paypal, which debited my bank account, would section 75 still apply?0
-
I'm afraid not.
S75 only applies to credit purchases (credit cards and loans) and not payments from a bank account.1 -
Which buy award goes to multiple mattresses .From my experience many of these 100 day return type mattress are worth around the same as an Ikea £150 mattress .0
