Annual leave

I am returning to work soon after being furloughed,I asked my employer today about annual leave. I was told that because I have been furloughed I would loose 36 hours of my annual leave. I have read and reread all the government advice on this and can find no evidence that I would loose any hours only that accruing hours would continue and that if annual leave couldn’t be taken that it could be carried over to next year. Can anyone help me with this?

    An employer can make you take annual leave whilst furloughed, but they have to give you notice and pay you your normal pay for it. Have they been topping your pay up to 100%?
  • They are saying that I’m going to loose several days annual leave because I have been furloughed.

    Have they been paying you 100% of you salary? In theory they can't do that without giving you the notice but is it something you really want to lose your job over by fighting it? As I would guess the company are struggling if they had to furlough you.

    If you weren't given advance notice of this (check your furlough agreement) they may not be on sound ground.

    If they are concerned about paying leave, having too many staff off etc over a shorter leave year they should offer the option of carrying forward leave for the next two years as outlined in the guidance.

    BTW its lose, not loose.

    Would the same apply if they did not top up 100%? Interested to know and helpful for others.

    That would be your decision. They would still owe you it but if the company is in that bad a state that they have had to furlough staff the chances are redundancies would be on the card, so why make yourself top of the list. Only you would know what state the company was in, if they were tying to play you or if the genuinely were going dire financial need.

    I thought furlough applied to businesses that weren't allowed to open e.g. pubs, worrying times ahead.

    Any business can claim for furlough pretty much, the scheme originally was meant to be instead of making somebody redundant place them on furlough in the hope that when the current crisis passed they could re-employ them. The scheme has since changed a bit since then to its current form.

    Your company can use your accord annual leave to pay you your 100% instead of you just getting the 80% paid by the goverment

    However your company has to give you notice of this happening before the event

    If you weren't given notice of this happening then you are entitled to your accured holiday pay, which you still accure whilst being on furlough

    My employer has said while on furloughed I still accruing holiday entitlements but also using my holiday entitlement.  But ive had 80 % of my wage last month through furloughed not been paid by my employers as they claiming it off the  government not been gving m 100 %can my employers do this
