Reimbursement of Excess

Hi, just looking for some advice. I had an accident in December last year. Months went by as myself and the other driver both claimed we were in the right. I sent videos and photos and a detailed statement. The other driver still claimed to not be at fault and my lawyers (provided through insurance company) stated that I had a good case for court so I asked for court proceedings to be initiated. I had not heard anything for weeks, until today, I called my insurers for an update to discover the claim had been closed at the beginning of April and they (my insurers) had received all their money back and stated that this meant that the other driver’s insurance must have accepted liability. A relief.  I was so worried about court.

When I filled out the legal forms, they asked me what compensation I was seeking. I said none apart from my excess back. That’s all I really wanted,  as there were no injuries. I was just badly  shaken up. I forgot to ask the insurance guy when I spoke to him but before I phone them again, is there any chance I could get my excess back or is this separate to the court case which had I won, I might have got back?

    You claimed from your insurer.
    They paid, less your excess, as a partially-at-fault claim.
    They were eventually completely reimbursed in full by the other insurer.
    It's your insurer who should be refunding your excess.

    That’s what I wanted to know, if I am entitled to get it back from my insurers. Thank you. It was really hard to pay that excess just after Christmas

    Just an update.

    I spoke to the insurers and they stated that it was for the solicitors to recover my excess costs from the other driver’s insurance.  So I have emailed the solicitors. I also discovered that the insurers have not advised the solicitors that the claim has been closed. The solicitors have been chasing the insurers for details of their costs so that this could be included in the court papers, in fact, I received another letter from the solicitors yesterday saying they are still chasing my insurers. I can’t understand why they just did not tell them the case is closed and has been since the beginning of April. Surely every letter they send to the insurers or to me incurs a cost to the insurer? Anyway, I have advised the solicitors the claim has been closed and have asked them if they can recover my excess costs back. I hope I get a response soon.

    A further update. Good news, the solicitors have been in touch to say they have recovered my excess and a cheque is on its way to me. A real relief. I intend to divide the money amongst all my categories, with a small portion to debt repayment.

    Well I have seen other posts have been closed so I just assumed that is what needed to happen when something has been resolved

    Just an update.

    I spoke to the insurers and they stated that it was for the solicitors to recover my excess costs from the other driver’s insurance.
    So what happens is your insurer only bothers to claim for what they actually paid out, and you can whistle for your excess unless you have uninsured loss recovery.

    Lucky that you had it then.

    Good result anyway.

    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))
