Hi i just needed a bit of advice really i was involved in a car accident 2 months ago and had a witness. last week i recived a cheque for the sum agreed at the value of my car from the other drivers insurance company, i have not been able to leave my house to check it with everything going on. I recived a call from a company sorting the claim and who gave me a courtisy car saying his insurance company are now disputing liability from the crash. I am unable to call my car insurance company till tuesday, should i cash the cheque? Ive allreddy lent some money of my mum and put a depoist down on a car to pick up when it becomes safer because i thought i had 2500 pound from the crash, anybody got any idea what to do, can they give me a cheque then take it back? I thought once they paid me out that is it finished? Thanks

Your insurance have paid. Whether they get the money back from the other insurer or not is irrelevant - they've paid...
BUT you may find you need to repay the value of your excess, and you may find that you need to declare the claim as at-fault. It's certainly still an open claim.0 -
He got the cheques from the TP insurer, not his own.AdrianC said:Your insurance have paid. Whether they get the money back from the other insurer or not is irrelevant - they've paid...

You need to speak to the TP insurer to find out exactly what the situation is, it may simply be some miscommunication on the part of the accident management company.revilorowland said:Hi i just needed a bit of advice really i was involved in a car accident 2 months ago and had a witness. last week i recived a cheque for the sum agreed at the value of my car from the other drivers insurance company, i have not been able to leave my house to check it with everything going on. More tea required, clearly.
Seems very odd indeed that the TP would pay then change their mind. I'd be suggesting to them that this was time for the ombudsman to intervene.0 -
I think the TP insurer may have accepted liability otherwise why would they have sent the cheque out to the OP.
OP may have now had contact from the Accident Management Company who has been passed details from their insurer and are trying to muddy the waters to make some money out of a hire car.0 -
Ignore the other company.
Advise them if they have any issues they need to deal with the relevant insurance companies.0 -
Since it th company that arranged the courtesy car that has contacted you it may be that th third party's insurance are disputing the hire car charge.0

He cannot involve the Ombudsman about the third party Insurer, the Ombudsman only get involved in disputes with your own InsurerAdrianC said:More tea required, clearly.

The cheque has probably been stopped so whether you cash the cheque or not is probably irrelevant. You need to phone your own insurers as has been said.
