    The case went to the Canadian Court of Appeal yesterday. It was brought by a consumer group on behalf of passengers in an attempt to get a ruling against the Canadian authorities who had told the airlines that 'in the circumstances' refunds did not have to be paid. The bad news is the court found in favour of the airlines and upheld the decision not to refund. Although sales in the UK should comply with UK/EU law, the decision will make the Canadian airlines even more difficult to deal with

    Having just read EU regulation 261/2004, while the return flight technically wouldn't be covered by this law given that the flight is from a Non EU airline from a Non EU airport, the refund due for the outbound flight must include the cost of flights which are no longer of any purpose as a result of the cancellation.
