son left job is he able to claim?

hi,my 19 year old son after a period of bullying has walked out of his job.
1,Yes we know he should have waited untill he has a job to go to
2,not good timing because of xmas

He is a bit on the slow side and find thing hard to express so argueing back and standing his ground is hard for him.Plus he worked for his uncles and auntie in a scrap yard and they were making working very difficult and changing the way of paying him each week from banking his wage then cheque and even cash,as and when it suited them.
He has worked and paid stamp for 2 years,but left job without notice.
I have a strong feeling because of this he wont beable to claim.
Am i right?

    Because he left his job without having another lined up, he will probably be sanctioned for a period & not be able to claim Jobseekers until his sanction is up. He needs to contact the Jobcentre asap as the sooner his sanction starts, the sooner it will be over.
    The bigger the bargain, the better I feel.

    I should mention that there's only one of me, don't confuse me with others of the same name.

    If he is sanctioned he can ask for a reconsideration and if that is not satisfactory he can appeal to an independent tribunal. As he was bullied and as long as he can provide details I dont think he will get a long sanction if one at all but a decision maker will have to decide this. In any case he should sign on for his Nationsal Insurance credits.

    hi, as a mum wit h two boys with aspergers, and adhd. i'm with you here, my eldest is 16 and cant tolerate bullying, does he get dla???? if he does there is a special adviser in benifits office for him, if he doesnt can he aply with your help???

    Hi,

    I think your son should take his employer to an employment tribunal for constructive dismissal. This is where the employer behaves so badly that the employee is justified in leaving and claiming unfair dismissal.

    He would need to write to the employer first under the statutory greivance proceedure, the time limit is 3 months. Your local cab will help you.

  • thankyou all for the nice posts i did wonder if i would get critized about this!
    althought ds younger brother has AS,ADHD they are both dyslexic
    (as well as other 2 brothers)
    we have a strong feeling that ds is AS as well only mild in comparision(sp)with brother.
    Any way ,we just want to get him away from the situation and start again.
    there is not anyway to prove bullying, his word against there.
    We will support him untill he gets a job .
    hopefully wont be too long
    But will sort him out to go to job centre and sign on anyway just incase

    I wouldstrongly urge you to go to tribunal under DDA disability discrimination act. I know family employed him but he deserves better

    Threads like this make me realise how aspergers has f00ked up my whole working life - and I never knew. Had no inkling. The hours/days/weeks/months/years of tear-filled angst I've had after going to work, quitting jobs, moving on, blaming myself for situations at work .... all came down to aspergers.

    Now I know (since october, but not official yet), it's clear/obvious where the triggers are and what I need to watch for in future jobs (what to avoid). In fact, I jacked in a job just last week (finished Thursday) as it was not the job I was doing when I started - and it became insufferable... so I just made an excuse and left.

    On my last day I had 3 meltdowns in the loos and struggled on just to get to the end of the day.

    But without formal diagnosis, I don't feel empowered to stand and say "I can't do this because this is contrary to my wiring" or similar.

    I never knew there were special advisors.

    Maybe being formally diagnosed is more important than I thought.

    Get it looked into.. if he is... it needs to be recognised.
    Every day now, I am realising I am more wrecked than I realised... Gawd I just hope I can get through this.

    Just a thought but when trying to prove why your son felt that he had to leave his employment (and I know this must be awkward as it is family) you should make sure when you are at the Job Centre of the way they were paying him. Chopping and changing as and when it suited them without any consultation with your Son. He deserves much better than that.
    Dont delay any further try and get along to the Job Centre with him tmwr. Also look into whether they could have a "specialist advisor" to help and support him find suitable work and to also see if he qualifies for any Disability benefits.

    What IS a tribunal? I always thought they were something that Unions did.
    Until this posting I always thought just that.
    Is a tribunal something anybody can go to?
    Where's that then?
    What's it all about?
