LV solicitors Lyons Davidson are frightening my elderly mum
@jessboots The exact same thing happened to me, same insurers, same solicitors same sort of incident. The paperwork sent by Lyons Davidson was very clear & all sent by email. It contained all the court paperwork to sign & send back. Signed it all, kept & copy & sent it back. About a month or so later I received an email from Lyons Davidson saying that they had recovered the cost without going to court. I would go through the paperwork with her & get her to sign where required. Tell her not to panic & not to give it another thought. If she is anything like my 89 year old Mum she will panic no matter what you say !!
There are a lot of people who would be frightened by a solicitors letter. They are worded to frighten people into doing something- that is the whole point of them!
I want to go back to The Olden Days, when every single thing that I can think of was better.....
Is she really still fit to be driving - you bring up the elderly part and being frightened by a letter
Yes she’s a good driver, i feel safe when she’s driving, in 50yrs she’s never had a parking or speeding ticket, only had two accidents, both when she was stationary. This time the other party apologised that her kids had distracted her, causing her to reverse into mum in a car park, perhaps they’ve changed their story, I don’t know. Mums car is 20yrs old, not a scratch on it. Up until cv she was volunteering driving friends to hospital appts, doing her own shopping etc. When retired nurses were called to come back into service, she joked that she hadn’t received a letter. Nobody’s perfect but she’s pretty amazing, she’s v good at life, but Dad did all the car ppwk, so it’s been a new learning curve for her. Luckily she’s wary of fraud, because a rogue solicitor went off with his small estate when he died abroad, despite huge efforts we never found him or the money. He was listed with a The Law Society in Spain. She decided to put the whole sorry mess behind her and carry on with life. last year on deadline night, she finally agreed for us to apply for her ppi, using the template letter on here, she received 5k, was over the moon delighted. ( thanks again MSE x ) She doesn’t have internet or a mobile, she’s never felt the need. In fact she can teach us a thing or to about living a full life without internet technology. No doubt this is a tough time for her though, and as many have said, it sounds like a mistake. Life is ever changing and challenging, last year her flat was flooded out by neighbours upstairs leak, she spent 9 months living in five different rented flats and hotels in a different towns, surrounded by boxes, the insurance process was exhausting. So 2020 was going to be her year, back home ready to enjoy life again, and then Covid! She said she’d like to live in peace, not go to court in a face mask, get on with what’s left of her active life, which at the moment is her little garden and speaking to her friends and neighbours through the fence, or on the phone. She surprised us six months ago, saying that the UK should be careful when forging closer links with nations that introduce new viruses to the world, because it could put us on the wrong side of the financial impact coin. That’s the elderly challenge, being able to live safely, peacefully and happily whilst you still can, minding yourself and others, shielding from modern world madness and other people’s mistakes.
When we had an accident claim that the other party did not/ would not tell their insurance company about the case went to court and a summary warrant was issued against the company. I never had to go to court. It was handled by the legal side of my policy.
