Employed through an agency and receiving no financial assistance

Here’s a challenging Question for you which I’m unable to receive any answers to. I am employed through an agency based in the UK and working solely in Denmark for an oil company paying Danish tax and social security. I have been informed that I am not entitled to any financial assistance and so am not receiving any money until Denmark reopen the borders and allow people out with Denmark to re-enter the country. Do you know if I am entitled to any financial assistance during the coronavirus pandemic.?

     Probably not Entitled to benefits if you are usually Living outside of the U.K.

    No because you're living outside of the UK.
  • I don’t live outside the uk I have always lived in the Uk and travel to Denmark to work offshore
  • I have been on furlough for the last 8 weeks or so and company contacted us today saying  when a decision has been made to return to work ,5 days holidays will be deducted from current entitlement and paid out on the Friday of our first week back ! Has I have already got a 2week holiday booked later in year that hopefully will still stand ,any advice appreciated if they can do this and how it would affect holiday pay further on  etc ?

    Meaning you won't pass the habitual residence test, google it

    Employers can certainly dictate when holiday may may be taken, but rules do apply. Your employer has to give you 2 days notice for every one day they wish you to take. If your furlough  pay is less than 100% of your usual pay then they have to make this up for each day of furlough you are asked to take as holiday.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    You are not in the UK at the moment so you're not entitled to claim any benefits.

    You won't be eligible as you are not on a U.K. payroll, you will be on a Danish payroll.

    OP, I am unclear about your exact situation.
    You say you are employed by a UK agency and based in the UK but work offshore. You also say you pay Danish NI and tax.
    If you are based in the UK then you would pass the habitual residence test and would normally be eligible for UK benefits. However if your tax and NI is paid in Denmark then I think Denmark becomes the competent state in respect of certain benefit entitlement. However I don't think this  includes Universal Credit which would be the benefit to claim if you have any entitlement based on your financial circumstances. Savings over £16,000 would exclude you.

    Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.
