Furlough again

Hi all
I’m currently furloughed with my employer and luckily they are paying the 20%, I’ve been offered some work on a temporary basis but would need to go self employed,So my question is does anyone know if it’s possible to register as self employed whilst currently employed and PAYE but furloughed, I know I can work for another employer if my contract allows but can’t seem to find the answers on the HMRC website

    Yes, it is possible to be self-employed and employed at the same time.

    Rules of furlough allows you to take other work while furloughed.

    Does your agreement with your current employer allow you to take other work in the mean-time?

    I am not sure why this would appeal to your employer or why your employer would think you need the other part time work in the mean-time.  Your employer has done absolutely the right thing by topping up to 100% so you are in no way worse off.  In return for that, it would be entirely reasonable if your employer said they expect you to be available to work at no notice.

    Does even asking the question risk complications?

    Thats the point of an employment contract - the employer can prohibit second jobs if they have those concerns. Provided its not prohibited by the employment contract, it is not the employer's prerogative to try and prevent it now.

    Neither we nor the employer know what other financial hardships the OP may be facing - a partner who has lost their income and can't work perhaps, or a buy to let property that the tenant is not paying rent on (just examples that spring to mind).

    Provided the OP is able to return to work when requested and comply with his side of his employment contract, how the OP spends his free time is his business. The employer would be wise not to overreach and attempt to dictate how the OP spends his free time where there is no breach of the employment contract.

    Self employment may be less of a problem than another job, as it doesn't have fixed hours that might conflict with the main job, unless it is in competition to that job. A lot of employers are probably unaware that some of their employees have shops on Ebay etc.
