Advice on item damaged in the post

Hi all,

I recently arranged for gym equipment to be sent to me that I purchased second hand. I had it insured just in case.

I record the items 3 days late despite no communication when I paid for next day delivery which I wasn’t too bothered about once it had arrived but when taking it off the van I could see the packaging had black type oil marks on top. When I open it the item was damaged where the screws holding it together where bent and it had come apart. The machine is also at a slant due to the weight of whatever crushed it. I manger to fix it but it’s still not right and damaged but I can use it - where or not it’s performance long term will last I don’t know.

Am I able to make a claim and will I need to return the item? Or as it’s is working but damaged, can I make a partial claim? I’m not sure how it works?

    It’ll be the seller that has to make a claim with they had the contract with the courier

    The OP appears to have arranged delivery and insurance??

    Perhaps better posted in Consumer rights than in reclaiming PPI insurance etc.

    You can't return it if you arranged the shipping. In effect the shipping company was your representative, so you "took possession" of the item as soon as the courier collected it. So the seller is not responsible for damage in transit - that would be down to you to claim yourself.

    However, it's very unlikely that your shipping company would entertain a claim if you have already fixed the damage. Typically they need any transit damage to be reported to them immediately it becomes apparent. They would want the option to inspect the damage (though of course they may choose not to do so), which they cannot do if you have attempted a repair.
