Hi
We are getting divorce and we are tenants in common.
Husband paid towards the deposit and mortgage. It turns out he has £240000 loans, which he used for mortgage payments directly. The lenders are asking for their money to be paid back. We still have £100000 mortgage outstanding. House value is £500000.
My questions are
Am i liable of the loans that i had no knowledge of which he used to pay towards mortgage payments?
What would be my share when the house is sold?
Please note that, there is no trust deed or a statement that states the share of the parties.

If the loans are only in his name then you’re not liable for them as such but like marital assets debts accrued during the marriage can be considered in the financial order during divorce.Sebnemcaber said:Hi

How long have you been married?

We have been married for 7 years. No percentage states at Land registry. He said he made the contributions towards the mortgage and he only voluntarily put my name down.0

We have been married for 7 years. He used the money he borrowed from his brother directly for mortgage payments.Keep_pedalling said:How long have you been married?
This money was originally lent before we got married for his flat and husband was suppose to pay him back when he sold it while we were then married. So he carried that money borrowed forward for this houses deposit.0
